2 – AGREEMENT
By using the Website you agree to be bound by these Terms and authorise us to transmit information (including updated information) to obtain information from third parties, including but not limited to, your debit or credit card numbers or credit reports to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
The contract to sell goods to you only relates to those goods listed in the confirmation email. We will have no obligation to sell any other goods which may have been part of your order until the dispatch of your goods has been confirmed in a separate confirmation email.

« Mimoza Hijab » : The company as defined in Part 1 which is selling goods via the websites www.mimoza-hijab.fr and www.mimoza-hijab.com
« The client » : Any person(s) or company(ies) buying a good on the websites operated by Mimoza Hijab.
« Goods » : Any good(s) being sold by Mimoza Hijab.
« Item » : Any good(s) being ordered by the user.
« Price » : Unit price of an item including all French taxes. Delivery cost or any additional charges are not included
4- PRODUCTS
The products offered for sale by Mimoza Hijab are those that are offered for sale and posted on the websites www.mimoza-hijab.fr and mimoza hijab.com . The products are subject to availability.
In the event of an unavailable product, Mimoza Hijab is committed to inform, by letter, the client of the partial delivery of the order or cancellation. Mimoza Hijab then agrees to refund the customer within 14 days of payment.
Descriptions of these are compiled with the greatest possible accuracy. Despite our best efforts some goods may be incorrectly listed on the website. In this case Mimoza Hijab could not be liable. The photographs and texts illustrating the products are
indicative only and are not contractual.
5 – PRICES
All prices shown on the Website are in Euros (€) inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. Any such additional charges such as delivery charges must be borne by you.
If your delivery address is outside of France you may be subject to import duties and taxes (including VAT)
You should note that customs policies and practices vary widely from country to country. We recommend that you contact your local customs office for information.
We reserve the right, however, to change prices at any time without notice to you (save that any changes will not affect orders in respect of which we have sent you a Dispatch Confirmation).
6 – HOW TO ORDER
The client must create a customer account to order on www.mimoza-hijab.fr and fill out a form containing the following information: title, name, complete delivery address, e-mail and phone number.
His account will be accessible through identification by email address and confidential password. Thereafter, the client should follow the following steps:

The customer declares to have read and accepted the terms and conditions before placing an order. Any order implies express acceptance of these terms of sale and the prices and descriptions of the items available for sale.

7 – PAYMENTS

The product invoice will be enclosed with the order in the package or emailed, especially if the client wishes to make a gift order.
1 - Online payment by credit card:
Under no circumstances Mimoza Hijab has access to your banking details.
Accepted cards are Carte Bleue, Visa, Mastercard and American Express. The customer’s account will debited 2 to 6 days after registration of the bank transaction.
2 Payment by Paypal:
The client, who already owns a Paypal account, will enter their email address associated with the account and paypal password.
In case of cancellation of the order, the Paypal account will be automatically credited.
In case of incomplete orders, the amount (s) missing items (s) will be refunded to the Paypal account.
3 - Payment by check:
When paying by check, it must be issued by a French domiciled bank. The check, made payable to "SASU MH", must be received within 3 working days following the confirmation of the order to the following address:

The order is enabled only upon validation of the check.
When using a Mimoza Hijab gift check to pay part or all of an order the customer will choose the payment by check. In the case of a payment by check, the order is released after receipt and validation elements.
In the case of a partial payment of the order, it is possible to pay the balance by one of the other payment methods offered by Mimoza Hijab. In each case, the order will be shipped upon reception and validation of the full payment.
4 - Payment by bank transfer
The transfer must be made from the customer's account to the account of the company Mimoza Hijab whose details will be send by e-mail upon registration of order. For transfers from abroad (outside of France) , whether in euros or other currencies, all bank charges or other charges will be borne by the client.
However, in accordance with Article L. 122-1 of the French Consumer Code, Mimoza Hijab reserves the right to refuse any order or delivery in case of a dispute exists with the customer, total or partial non-payment of previous order by the customer, refusal to authorize payment by credit card banking institutions, non-payment or partial payment using a Debit or Credit card not issued by a French financial institution. Mimoza Hijab will not be in any way held liable in this respect. In the event that the customer's bank account is not denominated in euros, the total amount payable is calculated based on the exchange rate of the day practiced by the bank to the customer.
8 – ONLINE PAYMENT SECURITY
Mimoza Hijab has chosen to secure your payments through the 3D Secure system.
The aim of the system is to apply additional control when shopping online by inviting you to enter a password or personal data (which varies depending on the bank) to allow your bank to identify you and to validate the operation. Hence this device is intended to reduce the risk of unauthorized use of your credit card if lost or stolen for example. Your card could not be used without entering the identification details described above.
To make the payment of an order on the website Mimoza Hijab by debit or credit card, the client must:
1 Enter his card number, its expiration date and the last 3 digits of the security code on the back of the card.
2 It will then be automatically redirected to the secure page of the bank which will then ask to enter a passcode.
3 Once the code is validated, it will be redirected to the website Hijab Mimoza confirming the payment validation and order number.
The allocation of a 3D Secure authentication code varies depending on the bank. Some banks define one with the client, others send SMS or through an electronic device that provides a code each time the customer makes a payment online.

9 – SHIPPING
Mimoza Hijab delivers its items around the world.
Delivery countries: the European Union: Belgium, Bulgaria, Cyprus, Denmark, Estonia, Finland, France, Greece, Hungary, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Slovakia, Slovenia and Sweden. As well as abroad: Switzerland, Canada, USA, Morocco, Algeria, Tunisia, Australia and the rest of the world.
To the extent possible, all orders are validated and shipped the business day which follows full payment. Warning: all validated orders on Friday will be shipped on Monday or Tuesday (depending on the carrier chosen by the customer).
Delivery times vary depending on the carrier and the destination delivery. They are indicative and in no case shall not be enforceable. In case of unusual delay, an email will be sent to the client.
Despite all the attention given by Mimoza Hijab in processing the orders, a product may turn out defective. Mimoza Hijab suggests the customer at reception of the order to verify the compliance of the products received. Any anomaly concerning the delivery must always be reported within 48 hours by registered mail to the registered office of Mimoza Hijab.
The customer can choose between 4-5 modes of shipping when placing the order:

- 5 International Priority Package
1 Colissimo: In France, La Poste will deliver the order within 48 hours to the customer's home without signature, the package is placed in the mailbox if its size allows it. Otherwise, a notice will be left asking the customer to go to the nearest post office to collect the package within 15 days.
2 Colissimo delivery against signature: the Post Office delivers the order to the customer within 48 hours against signing it home. In case of absence, a notice will be left in the mailbox.
For delivery time in France using the above shipping companies, we refer to their terms and conditions. Shipping outside of France: delivery time by Colissimo and / or Colissimo vary depending on the destination country and will be shown at the completion of the order by the customer.
The price of shipping is indicated at the time of the order, it varies depending on the weight of the package, choice of carrier and delivery address.
Mimoza Hijab offers the customer the cost of delivery by Mondial Relay in France for any order from 89 €.
Shipping risks are fully borne by the customer after the product is released by the company.
The customer must check the conditions of the packaging and the compliance of the order, and issue otherwise all reservations on the delivery note and inform Mimoza Hijab.
Mimoza Hijab shall not be liable in case of:
- Loss, theft or damage of a package upon delivery regardless of the user shipping mode
- Shipping delays due to the carrier
- Returned parcels due to inaccurate or incomplete details provided by the customer.
10 – CUSTOMS DUTIES
Any order placed on the site www.mimoza hijab.fr and www.mimoza hijab.com shipped outside of France may be subject to taxes and customs duties which are levied when the package reaches its destination . These duties and any such taxes related to the delivery of an item are the responsibility of the customer. Mimoza Hijab is not required to check and inform clients of customs duties and taxes. Customers should ask information with the relevant bodies in their country. In case of refusal of the consignee to pay customs duties and taxes, any sums required to Mimoza Hijab to retrieve the package will be deducted from the refund made to the customer.
11 – RIGHT TO WITHDRAW
According to the law, the customer has a right to withdraw within a period of 14 days from the date of receipt of the package without any justification and without penalties. Provided that the product(s) is/are returned in their original condition (new, unworn, unchanged, undamaged, in their entirety, with all their accessories and their packaging of origin). Otherwise, Mimoza Hijab reserves all rights to refuse the returned items.

12 – SATISFIED OR REFUNDED GUARANTEE (c’est la meme chose que le pragraphe precedent sauf que ce dernier relève du code de la consummation.Je supprimerais…)
The customer shall have a period of fourteen days from the date of receipt to return at its expense and its own risk, products ordered, for exchange or refund. All returns must be returned in their original condition (new, unworn, unchanged, undamaged, in their entirety, with all their accessories, and in their original packaging and accompanied by a letter indicating the reference of the order and will of the customer. all the return costs are borne by the customer.

For an exchange: The customer will be credited with a credit for the amount of product they wish to exchange. He will then have the responsibility to order the product of choice for exchange.
To request a refund: Mimoza Hijab will refund the product within 14 days from the date of receipt of the request.

All content, images and sounds used on this site are owned by Mimoza Hijab. Any copy, adaptation, translation, representation or modification even partial is strictly prohibited without the prior written consent of Mimoza Hijab and may be subject of a lawsuit.
Nothing contained herein shall be construed as conferring any license or right under any Mimoza Hijab, copyright or trademark.
15 – LIABILITIES
Mimoza Hijab will strive to ensure customer satisfaction, however it is only bound by an obligation of means. Mimoza Hijab is committed to ensuring compliance of its products under Articles L211-4 and following of the Consumer Code and replace or refund any item showing hidden defects (Article 1641 of the Civil Code). The customer agrees to provide Mimoza Hijab correct credentials and their possible updating. In case of incomplete or incorrect information transmitted by the client or information, Mimoza Hijab can not liable or forced to reimbursement or return of the product concerned.
Furthermore, liability can not be engaged for
- Any inconvenience or damage related to the use of the Internet (interruption of service, external intrusion or presence of computer viruses)
- Any breach of its contractual obligations in the event of a major event and / or unexpected internal or external strike, disaster, fire, disaster, internal or external failure, and generally any incident that will not allow the proper order processing. (This list is not exhaustive)
Thus, in case of force majeure or fortuitous event, Mimoza Hijab undertakes to inform the customer within seven days of its occurrence. These Terms & Conditions are subject to French law. In case of dispute, French courts will have jurisdiction.
